Dymnd Beta Program Terms of Condition

Welcome to Dymnd! These Terms of Service ("Terms") govern your access and use of the Dymnd mobile application (the "App") developed and operated by Dymnd Enterprises LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

The App allows you to upload photos, write entries, and track habits (collectively, "User Input Content"). You retain all ownership rights to your User Input Content. However, by uploading User Input Content, you grant us a non-exclusive, royalty-free license to use your User Input Content in connection with the operation of the App.
To the extent permitted by law and the terms of our third-party AI provider, you are granted a non-exclusive, worldwide, royalty-free license to the text, images, or other content generated for you by the AI Agent ("AI Output") for your personal use within the App. This license is conditional on your compliance with these Terms. You acknowledge that AI Output is provided for informational purposes only and is not guaranteed to be unique.
4. AI Agent Disclaimers and Limitations
The AI Agent is a machine-learning language model powered by a third party (Google's Gemini). The AI Output may contain inaccuracies, factual errors, or biased content ("Hallucinations"). You should not rely on AI Output as fact. We make no warranties or guarantees regarding the accuracy, reliability, or completeness of the AI Output.
AI Output, particularly relating to health, nutrition, or cosmetic information, is for informational and entertainment purposes only. It is not a substitute for professional medical, health, or financial advice, diagnosis, or treatment. Always seek the advice of a qualified professional.
You are solely responsible for your use of the AI Output, including any actions you take or don't take as a result. You assume all risk and liability for any reliance on AI Output.

The App relies on certain third-party services, including Google's Gemini API to provide the AI Agent functionality, and may contain links to other third-party websites or services. We are not responsible for the content, security, or practices of any third-party websites or services, including the processing of your interaction data by our AI provider.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association ("AAA"). The arbitration will be held in Wilmington, Delaware. The decision of the arbitrator will be final and binding on both parties.

These Terms constitute the entire agreement between you and us regarding your use of the App.

We may update these Terms at any time by posting the revised terms on the App. You are responsible for checking the Terms periodically for updates. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
